Session Cancellations

We request that you cancel at least 48 hours before a scheduled session. If your cancellation is less than 24 hours in advance, you forget your appointment, or become unavailable for your appointment time, you will not be reimbursed for the cost of the session. Providers are only required to wait eight minutes after the start of the session time.

Rights, Consent, and Confidentiality

Client Rights
As a client of Positivity+, you have the right to:

  • Receive services regardless of age, race, creed, disabling condition, gender, national origin, religion, social status, sexual orientation
  • Privacy and confidentiality of your information, except in the case of an emergency, court order, threat of harm to self or others, or evidence of child abuse or neglect
  • Access to information contained in your record under the supervision of your therapist and/or medical doctor, or other staff designated by Positivity+
  • Access to the complaint/grievance process
  • Be informed of the financial aspects of treatment, including charges to your account based on the scale of fees established
  • Ask questions about the counseling process and receive answers regarding your treatment
  • Terminate counseling at any time, for any reason
  • Be informed of risks involved with the use of psychological measurements, counseling and therapeutic techniques, and the counseling process
  • Be protected from harm
  • Be accorded human respect and dignity
  • Be involved in your mental health care
  • Personal liberty

Confidentiality
You understand that information concerning your treatment will be held in confidence by the Health and Counseling Center unless you give written consent for the release of information. However, there are certain situations in which therapists/coaches are ethically bound to reveal information without your consent when:

  • You verbally express bodily harm or death to another person
  • You make report to commit suicide
  • A court order has been issued for your records
  • An internal audit or review is conducted by the Executive, Legal and Administrative personnel of Positivity+
  • Suspected or known abuse and/or neglect of a minor child, an intellectually disabled individual, or an elderly adult
  • A quality service agreement between Positivity+ and another agency
  • In case of an emergency, your therapist/coach is authorized to request or release information necessary to resolve the immediate crisis.

The staff at Positivity+ is permitted to make disclosures of your Protected Health Information (PHI) for treatment, payment, and health care operations without your consent.

Consent for Treatment
The counseling process has potential risks and benefits. Potential risks include recalling unpleasant memories, feeling stressed associated with change, and experiencing intense feelings. Potential benefits include improved coping skills, increased ability to concentrate, and enhanced relationships with family and friends. The counseling process is provided through therapeutic interventions such as individual counseling, group counseling, couples counseling, and psychological testing. If you are unwilling to participate in treatment due to risks associated with counseling, you have the right to decline the use of these therapeutic interventions and an alternative method will be used that provides you the most comfort with the counseling process.

 

Liability

Affordable TeleMental Health, LLC apps are created to represent a brand, facilitate flow of information, and/or improve communication from a person/entity/organization to an audience. Affordable TeleMental Health, LLC apps are not intended for use in emergency situations where time is critical and should not be depended upon as a sole resource for information in those circumstances. Affordable TeleMental Health, LLC creates apps but app owners control the content displayed in their apps. Affordable TeleMental Health, LLC is not responsible for any content within any app.

Who Can Use Affordable TeleMental Health, LLC

We want our Service to be as open and inclusive as possible, but we also want it to be safe, secure, and in accordance with the law. So, we need you to commit to a few restrictions in order to be part of the Affordable TeleMental Health, LLC community.

  • You must be at least 13 years old to be part of the community.
  • You must not be prohibited from receiving any aspect of our Service under applicable laws or engaging in payments related Services if you are on an applicable denied party listing.
  • We must not have previously disabled your account for violation of law or any of our policies.

Affordable TeleMental Health, LLC is not a place to support or praise terrorism, organized crime, or hate groups. Offering sexual services, buying or selling firearms, alcohol, and tobacco products between private individuals, and buying or selling illegal or prescription drugs (even if legal in your region) are also not allowed.

We have zero tolerance when it comes to sharing sexual content involving minors or threatening to post intimate images of others.

Maintain our supportive environment by not glorifying self-injury.

Encouraging or urging people to embrace self-injury is counter to this environment of support, and we’ll remove it or disable accounts if it’s reported to us. We may also remove content identifying victims or survivors of self-injury if the content targets them for attack or humor.
Don’t use the Affordable TeleMental Health, LLC Platform for any app that constitutes, promotes or is used in connection with spyware, adware, or any other malicious programs or code.

Don’t attempt to build an ad network on Affordable TeleMental Health, LLC.

Don’t reverse engineer the Affordable TeleMental Health, LLC APIs or any of Affordable TeleMental Health, LLC apps.

Comply with all applicable laws or regulations. Don’t provide or promote content that violates any rights of any person, including but not limited to intellectual property rights, rights of privacy, or rights of personality. Don’t expose Affordable TeleMental Health, LLC or people who use Affordable TeleMental Health, LLC to harm or legal liability.

You can’t impersonate others or provide inaccurate information.

You don’t have to disclose your identity on Affordable TeleMental Health, LLC, but you must provide us with accurate and up to date information (including registration information). Also, you may not impersonate someone you aren’t, and you can’t create an account for someone else.

  • You can’t do anything unlawful, misleading, or fraudulent or for an illegal or unauthorized purpose.
  • You can’t do anything to interfere with or impair the intended operation of the Service.
  • You can’t attempt to create accounts or access or collect information in unauthorized ways.
    This includes creating accounts or collecting information in an automated way without our express permission.
  • You can’t attempt to buy, sell, or transfer any aspect of your account (including your username) or solicit, collect, or use login credentials or badges of other users.
  • You can’t post private or confidential information or do anything that violates someone else’s rights, including intellectual property.

Content Removal and Disabling or Terminating Your Account

We can remove any content or information you share on Affordable TeleMental Health, LLC if we believe that it violates these Terms of Use, our policies, the law. We can refuse to provide or stop providing all or part of the Service to you (including terminating or disabling your account) immediately to protect our community or services, or if you create risk or legal exposure for us, violate these Terms of Use or our policies, if you repeatedly infringe other people’s intellectual property rights, or where we are permitted or required to do so by law.
